In accordance with Articles 13 and 14 of the European Regulation (EU) 2016/679 (hereinafter GDPR) and concerning the personal data that the Data Controller will have available, we communicate the following:

The personal data processed through the use of the "Innova" application (hereinafter also defined as the "APP") are the email address and password entered during registration. Additionally, location data of the device, time zone settings, IP address, operating system details, and other technologies of the product or device used to access the service provided by the APP are collected.
The purposes of the processing are: (i) management and control from home or remotely of the equipment purchased by the User through their smartphone, tablet, or PC; (ii) providing remote technical assistance to the User.
The legal basis for processing is the performance of a contract.

The Data Controller has adopted adequate security measures to preserve the confidentiality, integrity, and availability of the User's personal data and imposes similar security measures on third-party providers and Data Processors. There is no automated decision-making process based on your data, including profiling. Data processing is carried out using computer tools with logics strictly related to the purposes of the processing.
If the Data Controller intends to further process the User's personal data for a purpose other than that for which they were collected, they will provide information about this different purpose and any other relevant information before such further processing, seeking consent if necessary.
Providing personal data is optional. However, to use the APP functionalities for the above-mentioned purposes, refusal to provide personal data will result in the inability to access and use the App.
Personal data are not disclosed and can be processed exclusively by authorized persons or external processors expressly appointed by the Data Controller for the purposes indicated in point 1.
If the User requests assistance by opening a ticket, the "Atalassian Jira Service Desk" software is used, which involves the transfer of data to non-EU countries in compliance with the adequacy decision on data transfer to the United States (EU-US Data Privacy Framework) of 10.07.2023. The sub-processor Atlassian Inc. and its subsidiaries have obtained adequacy self-certification through the "Data Privacy Framework" (DPF) managed by the US Department of Commerce (verifiable at the link https://www.dataprivacyframework.gov/list). The sub-processor's privacy policy is available at https://www.atlassian.com/legal/privacy-policy#how-we-transfer-information-we-collect-internationally. This data transfer outside the EU is also allowed under Article 49(b) GDPR, as it is necessary for the performance of a contract (help desk assistance) at the User's request.
Data are retained for up to 5 years from the last use of the APP, after which they will be permanently deleted.
Under EU Regulation 2016/679 Articles 15 and following, and the current national legislation, the User can exercise the following rights according to the methods and within the limits provided by the current legislation:
To exercise these rights, the User can send a request to info@innovaenergie.com, providing the necessary information for identification. Before responding, the Data Controller might need to verify the User's identity, as these rights can be exercised only by the User or their delegate.
